These Terms of Service (“Terms”) govern your access to and use of the ParryUp™ platform, including our website, mobile applications, and associated software services.
By creating an account or using ParryUp™, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
1. Description of Service
ParryUp™ provides a specialized scheduling, billing, and management software platform designed for fencing clubs, tournament organizers, fencers, and their families. We provide the software infrastructure that allows clubs and organizers to manage classes, camps, tournaments, and communications.
ParryUp™ is a technology provider, not a fencing club. We do not host, organize, or manage physical fencing events, nor are we responsible for the safety, quality, or execution of the classes or tournaments managed through our platform.
2. Account Eligibility and Registration
- Age Requirement: You must be at least 18 years old (or the legal age of majority in your jurisdiction) to create an account on ParryUp™. Minors may not create accounts.
- Managing Minors: Adult account holders may create dependent profiles to manage scheduling and participation for minor fencers. By adding a minor to your account, you represent that you are the parent or legal guardian with the authority to manage their information and agree to event waivers on their behalf.
- Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3. Payments, Billing, and Refunds
ParryUp™ facilitates payments between you (the user) and the fencing club or tournament organizer (the merchant).
- Merchant of Record: When you pay for classes, camps, merchandise, or tournament fees through ParryUp™, your financial transaction is directly with the respective club or organizer, not with ParryUp™.
- Third-Party Processors: We use secure third-party payment processors. We do not directly store your full credit card information on our servers.
- Refunds: Because ParryUp™ is solely the processing infrastructure, we do not issue refunds. All refund requests, payment disputes, or cancellation inquiries must be directed to the specific fencing club or tournament organizer.
4. User Conduct and Responsibilities
You agree to use ParryUp™ only for its intended purposes. You agree not to:
- Use the platform for any illegal or unauthorized purpose.
- Interfere with or disrupt the security, integrity, or performance of the platform.
- Input false, misleading, or inappropriate data into schedules, tournament brackets, or messaging features.
- Attempt to gain unauthorized access to other users’ accounts or the underlying Google Cloud Platform infrastructure.
ParryUp™ reserves the right to suspend or terminate accounts that violate these Terms or disrupt the experience for clubs and organizers.
5. Assumption of Risk and Liability Waivers
Fencing is a physical sport that carries inherent risks of injury.
- Club Waivers: You may be required to sign or digitally agree to liability waivers, medical releases, or codes of conduct provided by your specific fencing club or tournament organizer through the ParryUp™ platform.
- Our Liability: ParryUp™ is not a party to those waivers. We bear no responsibility or liability for any physical injuries, damages, or losses sustained during any fencing class, camp, or tournament managed via our software.
6. Privacy, Data Processing, and Record Retention
Your use of ParryUp™ is also governed by our Privacy Policy.
- Data Roles: By using the service, you acknowledge that ParryUp™ acts as a “Data Processor” on behalf of the fencing clubs and tournament organizers (“Data Controllers”). We process and secure your data according to their instructions and our Privacy Policy.
- Data Retention: As outlined in our Privacy Policy, ParryUp™ retains historical data—including past class reservations, attendance records, payment and billing history, as well as tournament results and seeding—for extended periods to support the legitimate business tracking, financial compliance, and historical athletic records of the clubs and organizers using our platform.
7. Limitation of Liability
To the maximum extent permitted by law, ParryUp™ and its founders, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform, the failure of the platform to operate uninterrupted, or any disputes between you and a fencing club or tournament organizer.
8. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will notify you via email or through a notice on the platform prior to the changes taking effect. Your continued use of ParryUp™ after the updated Terms go into effect constitutes your acceptance of the changes.
